LEGAL NOTICE

This “PSG official” mobile application accessible / downloadable via Apple Store and Google Play (“the Application”) is published by Paris Saint-Germain Football, a “société anonyme sportive professionnelle” company with capital of 340,000,000 euros, whose head office is located at 24 rue du Commandant Guilbaud in Paris (75016), registered in the Paris Trade and Companies Register under number 382 357 721, telephone 01 47 43 71 71 (hereinafter, "the Publisher").

GENERAL CONDITIONS OF USE OF THE APPLICATION AND THE CONTENTS

The terms and conditions under which the Publisher makes the Application available to the User, as defined below, are defined by these general conditions of use (hereinafter, the “T & Cs”).
Access and use of part of the Application are exclusively reserved for people (hereinafter the “User (s)”) who have created an account (hereinafter the “Paris Saint-Germain Account”) via a registration form in accordance with article 1.2 of the T & Cs.

The Application notably allows access on iOS or Android smartphones to the following content and functions:

  • News: news from the Paris Saint-Germain teams (men's and women's football, handball, judo ...) and the Club (Foundation, Academy ...);
  • Media and Video: Live streaming (press conferences, trainings, pre-matches) / Multicam at the Parc des Princes / Live streaming / other PSG TV content on VOD;
  • Results, rankings and number of players of Paris Saint-Germain teams (men's and women's football, handball)
  • Commented live of Paris Saint-Germain first team matches;
  • Statistics: statistics before matches;
  • Shop: purchase of products and services marketed by Paris Saint-Germain or its partners such as general public tickets, PSG TV passes or My Paris membership offers (an adult User can purchase an offer for himself or for his / her children);
  • Personal area: modification of the profile, management of dematerialized tickets, display of the My Paris card, management of the credit cards associated with his profile.


Hereinafter the "Content (s)"
Some Content is only accessible inside the Parc des Princes stadium located 24 rue du Commandant Guilbaud, 75016 Paris;
Users acknowledge and accept that access to certain Content offered by the Application may, at the Publisher's discretion, be subject to subscription to a paid subscription.

1. ACCESS TO THE APPLICATION AND THE CONTENT

1.1 Intellectual property rights relating to the Application and its Content

The Application and any platform used in connection with it may contain confidential information protected by French law.

The Publisher enjoys the exclusive right to distribute, publish, reproduce and communicate to the public all or part of the Application and its Content. All trademarks relating to the Content and areas of activity of the Publisher are trademarks protected by deposits in his name. All of these elements include, but are not limited to, the brands, models, logos, images, texts, sounds and other documents which are and remain the exclusive property of the Publisher.

The User is prohibited from making any distribution, copy, duplication, modification, alteration, transfer, representation or reproduction, in whole or in part, of the Application, of the third-party platforms linked to it and which are edited and controlled by the Publisher, of the Content or of one of the elements which compose it in any way and for any reason whatsoever. Failure to comply with this prohibition is likely to constitute an act of counterfeiting engaging the responsibility of its author.

The User is also prohibited from copying, modifying, creating a derivative work, reversing the design or assembly or in any other way attempting to find the source code (except in cases provided for by law), selling , assign, sub-license or transfer in any way whatsoever any right relating to the Application, to the third-party platforms which are linked to it and which are edited and controlled by the Publisher, to the Content or to any of the elements that compose it.
As an exception to the above, the User may reproduce, publish, copy, duplicate or modify for strictly non-commercial purposes the only Content that he would be required to generate himself, of his own doing, by using modules or functionalities, existing or future, specifically provided for this purpose.

1.2 Registration on the Application

In order to have access to all the Content offered, the User must download the Application and connect to it via a mobile terminal (the "Terminal") by:

  • Creating a Paris Saint-Germain Account for which the User must provide the following information: name, first name, gender, email address, date of birth, password as well as any other information requested on the Application;
  • Authenticating from their accounts on third-party platforms including Facebook sign-in, Google sign-in, Apple sign-in (iOS only). The User acknowledges and accepts that this list is liable to change.

By creating a Paris Saint-Germain Account, the User acknowledges and accepts that he has created an account linked or likely to be linked to other platforms published and controlled by the Publisher, including:

  • PSG website (url FR:https://www.psg.fr/);
  • Ticketing site (url FR: https://billetterie.psg.fr/fr/);
  • My Account (url FR:https://myaccount.psg.fr/);
  • PSG Mon Abo application.

The User acknowledges and accepts that the aforementioned list of platforms is not exhaustive and may change at the discretion of the Publisher.

The Publisher undertakes to provide accurate information and not to usurp the identity of any person, for any reason and in any manner whatsoever.

The Publisher reserves the right to refuse or cancel the User's registration if the information provided is inaccurate or if the registration is made in violation of these T & Cs and the laws and regulations in force.

The User then has the option of completing his profile.

1.3 Acceptance of the T & Cs on the Application

Use of the Application is subject to full and complete acceptance of these T & Cs and compliance with them by the User. By identifying himself on the Application, the User acknowledges having read and accepted the T & Cs.

The T & Cs are subject to change by the Publisher at any time. The new T & Cs will be applicable to all access to the Application following the change of the T & Cs. The User therefore undertakes to consult the applicable T & Cs before connecting to the Application. By identifying himself on the Application, the User accepts the new T & Cs.

1.4 Acceptance of the T & Cs on the Application

On Apple Terminals (iPhone, iPad), the Publisher offers Users of the Application to access Paris Saint-Germain’s paid video contents in exchange for the payment of subscription fees. 

Users from all over the World can subscribe to the following offers, of which the prices are fixed:

  • PSG TV - Monthly Pass (1 month) :1.99€ per month, 1-month subscription with automatic renewal, i.e. 23,88€ per year;
  • PSG TV - Annual Pass (1 year) :9.99€ per year, 1-year subscription with automatic renewal.

By subscribing to the PSG TV - Annual Pass (1 year), Users save 58.20% of the amount they would pay by renewing a PSG TV - Monthly Pass (1 month) subscription over a period of one year i.e. 13,89€ of savings or 12 months at 0.83€/month.

Users are informed that they will be debited upon confirmation of their subscription to the Paid Content. At the end of the subscription, the Publisher will send an e-mail to the Users to confirm that their subscription has been taken into account and activated.

At the end of the subscription period, the subscription is automatically renewed. If Users wish to unsubscribe, they must do so manually in the Application settings or, if they use iOS Terminals, in the iTunes settings.

Use of Apple's services, including in-app purchases, is governed by Apple's Services Terms and Conditions and their Privacy Policy. The User acknowledges having read them and having agreed to abide by them by subscribing to Apple services. The Publisher declines all responsibility regarding the use of In-app purchase operated by Apple via the "PSG officiel" mobile application.

2. USE OF THE APPLICATION AND THE CONTENT

The Publisher cannot be held responsible for any misuse of the Application by the User.
The User undertakes within the framework of the use of the Application, and without this list being exhaustive, not to:

  • send spam or unsolicited messages (advertising or other);
  • disseminate or use elements protected by an intellectual property right or any right held by a third party in a manner which is not expressly provided for by these T & Cs;
  • use the Application to harm a third party and / or Paris Saint-Germain;
  • attempting to enter without authorization into the Paris Saint-Germain Accounts of others, into paid sections of the Application without being authorized or into computer systems and networks controlled by the Publisher or connected to a server of the Publisher or third parties, by hacking, searching for passwords or any other means;
  • modify, adapt or hack the Application;
  • collect or store data from other Users;
  • transmit or send any content which would be illegal, or which could constitute an incitement to the carrying out of crimes and misdemeanours, defamations and insults, invasion of privacy, or even acts endangering minors;
  • transmit any message or information of which the User would not be authorized to disseminate the content such as in particular, the shooting (s) and / or sound (s) and the visual and / or sound recordings made in the enclosure the Parc des Princes, with the exception of transmission for strictly personal purposes within the framework of the family circle and the sphere of private life;
  • transmit any message the content of which would violate any intellectual property right, in particular any patent, trademark, trade secret or any other right belonging to others;
  • transmit any message containing computer viruses or any other code, file or program designed to interrupt, destroy or limit the functionality of any software, computer, or telecommunication tool without this list being exhaustive;
  • violate, intentionally or not, any national or international law or regulation in force as well as the limitations contained in the T & Cs.

The User undertakes not to do anything likely to damage the notoriety or the reputation of the Publisher, and / or its managers, shareholders, employees and other partners, and / or ethics athletic. The User undertakes to use the Application for purposes consistent with public order, public safety and good morals and will, in any event, be held solely responsible for any breaches of public order, to public safety and good morals which could result from its use of the Application.

The User undertakes to fully guarantee the Publisher, its employees, agents and partners, against any complaint, claim or procedure from third parties related to the wrongful use of the Application or the Content by the User, for non-compliance with his obligations and more generally for fault or negligence on the part of the User.

3. GUARANTEE AND RESPONSIBILITIES

The Application is made available as is and without express or implied warranty of any kind. The Publisher does not guarantee to the User that the Application will be error-free and that the Application will meet the needs and expectations of the User.

The Publisher cannot be held liable in the event of damage or unavailability of the Application caused by any event qualified as force majeure within the meaning of French law and case law, as well as in the event of non-performance or improper execution of the T & Cs attributable to the User or the unforeseeable and insurmountable fact of a third party.

As such, the Publisher is not responsible for the unavailability of its servers and the Application, due to the interruption or disruption of telecommunications networks.

The Publisher reserves the right to interrupt and momentarily suspend access to all or part of the Application, in order to ensure its maintenance, updating or in the event of technical failures, without the interruption giving right to any obligation or compensation. The Publisher cannot be held liable for any inconvenience or damage inherent in the use of the Internet network. In particular, any disruption in the provision of the Application cannot engage the responsibility of the Publisher.

The Publisher strives to ensure, to the best of its ability, the accuracy and updating of the information published on the Application, the Content of which it reserves the right to correct at any time and without notice. However, the Publisher cannot guarantee the accuracy, precision or completeness of the information made available on the Application.

The Publisher is not responsible for the use by the User of the Content.

Use of Apple services, including through in-app purchases, is governed by Apple Media Services’ Terms and Conditions and by their Privacy Policy. The User acknowledges having read them and having undertaken to respect them by subscribing to Apple services. The Publisher declines all responsibility for the use by a User of In-app purchase (in-app purchases) operated by Apple via the “Official PSG” Mobile Application.

4. ACCESS TO THIRD PARTY SITES

4.1 Link to third party sites

The Application may contain links to other applications / sites not published or controlled by the Publisher who cannot be held responsible for the operation, content, updates, changes, services or products or any item present or obtained through these applications / sites. The establishment of such links or the reference to any information, articles or services provided by a third person, cannot and must not be interpreted as an express or tacit endorsement, by the Publisher, of these sites and these elements. nor of their contents. The Publisher is not responsible for the use by Users of these third-party sites and applications.

The User undertakes to read and comply with the General Conditions of Use of these third-party sites and applications.

Any questions, comments or complaints relating to an application / site other than the Application should be addressed to the operators, publishers or hosts of these applications / sites.

4.2 Link to third party sites edited and controlled by the Publisher

The Application may contain links to Third Party applications / sites edited and controlled by the publisher, including in particular but not limited to the sites psg.fr, billetterie.psg.fr, experience.psg.fr, foundation.psg.fr .

The User undertakes to read and comply with the General Conditions of Use of these third-party sites and applications.

4.3 Wifi connection and location

The User acknowledges that, in order to have access to some of the Application’s features within the Parc des Princes, connection to WiFi and activation of the location are required.

On certain versions of iOS and Android, the User is warned that the connection to the Parc des Princes Wi-Fi may not be sufficient to give him access to the aforementioned Content.

The User must then expressly authorize the Application to access his location and allow the Publisher to obtain the information on his position to access said Content.

Prior to any connection, the User must read and accept the general conditions of use of the Parc des Princes Wifi by clicking here.

The User can prevent the Application from accessing his location at any time in the Application or Terminal settings.

4.4 Notifications

The Publisher is likely to send Users notifications specific to news from Paris Saint-Germain and in particular but not limited to news from the men's first football team, the women's first football team, first men's handball team and the My Paris program.

The User will only receive notifications from the Publisher if he has activated this feature from the settings of the Application or Terminal used to access the Application or if he accepts through a request from the Publisher in the form of a pop-up window. The User can decide at any time to deactivate the notifications in the settings of the Application or Terminal.

VARIOUS

1. DISPUTES - APPLICABLE LAW

In the event that one or more of the non-essential clauses of these T & Cs are null and void, for any reason whatsoever and in particular following a change in legislation or regulations, or by the effect of a court decision, this can in no way affect the validity or effects of these T & Cs.

These T & Cs are governed and interpreted in accordance with French law, without taking into account the principles of conflicts of laws.

In the event of a dispute that may arise during the interpretation or execution of the T & Cs, the User and the Publisher expressly agree to submit such a dispute to the exclusive jurisdiction of the competent courts of Paris, France.

The User is informed of the possibility of having recourse, in the event of a dispute, to a conventional mediation procedure or to any other alternative mode of dispute settlement.

2. LANGUAGE

These T & Cs are written in French. A translation into other languages can be provided for information. In case of contradiction, only the French version will prevail between the parties.

3. PERSONAL DATA
